1) andalucia2.com Travel, licence number: C.I.AN-29767-2, intermediary agency, is part of Andalucia 2000 en la red, S.L., company on line, (henceforth to be known as andalucia2.com) serves as intermediary between wholesale travel agencies, tour operators, hotels and other tourist accommodation, establishments and providers and the end User.
Our system offers: A tourist guide to Andalucia and travel services such as hotel reservations and car rental, in all of Andalucia, as well as other services that we will soon be offering. You can use our services 24 hours a day, seven days of the week and 365 days of the year.

2) The User understands and accepts in their entirety the General Conditions that are set out below, accepting responsibility for the costs derived through use of any of the services on this web page. The User recognise that all images, photographs, animations, video, audio, music, text, incorporated into the web-site are owned by andalucia2.com or third parties, its suppliers or clients. Mere use of the website implies total acceptance by the User who agrees that the General Conditions have been read and expressly accepted.

3) If you do not agree with any of the General Conditions set out below, you may not use this service.

4) User declares that he/she is over 18 years of age and legally entitled to contract the travel services offered here.

5) These General Conditions determine the rights and obligations of andalucia2.com and the User to reserve accommodation and other travel services on our website. Nonetheless, as the offers are made by third parties (such as hotels, tour operators, car rental firms etc.,) they are also subject to the General Special Conditions of the Providers/Suppliers (their Conditions can be seen by clicking on the relevant icon on the reservation pages) of the respective hotel establishments and other services.

6) Ensure, before purchasing or making any reservation, that you have read and understood the clauses of these General Conditions and the specific/special Conditions and information pertaining to the product or service on the relevant pages of our website, it is your responsibility to do so. To make a reservation is not necesery you register with us.

7) These General Conditions and the Special (Specific) Conditions of the provider apply to all reservations made by telphone, whether land or mobile, by fax or through the Internet.

8) If you wish to contact us in connection with any aspect of the General Conditions you can do so by sending .

9) andalucia2.com informs you that, when you fill out a registration form, we understand you authorize us that, your personal details will be added to, and kept in, the files of andalucia2.com -C.I.2032960077- to enable us to supply our services to you, process your orders and send you information relating to those orders.
Naturally, as dictated by the LOPD (PDPA), you have right of information, access, rectification, oposition, cancellation and revocation of your personal data under the terms included in the same.
To exercise this right, requests must be made in writing, signed by the individual whose data it is and addressed to Andalucía 2000 en la red, S.L., Crtra. Nal. 340, km. 144, Edificio Bali, 1°, 3ª, 29692, Sabinillas, Manilva, Malaga, indicating your home address so that your request can be confirmed and responded to, and you must include a copy of your National Identity Document or Passport, via Fax: 952 892 839, Burofax or including a copy of your document.
In reserving products or services you authorize andalucia2.com to pass your details to the hotel or provider of services so that, with full care of your details, such as name, postal and e-mail addresses, credit/debit card details (in the case of pre-reservations) etc., they can use them, since they are necessary for the provision of service, on to the Hotel or service provider for the processing of your request.
We warn all Providers very clearly to take the greatest care with your data and remind them of the Personal Data Protection Act ( LOPD ).
I expressly authorize andalucia2.com and the Provider of the service to send me e-mails relating solely to this product purchase / rental or reservation but never to send unsolicited offers.
All communications produced electronically (e-mail) between the User and andalucia2.com will be saved to permanent media accessible for later consultation for a period described by law. Such communications can be produced as evidence in case of any dispute over services or payments not satisfied and we will ask compensation under the law for non-payment or unjustified retraction of payment made by debit/credit card. andalucia2.com guarantees the integrity and non-manipulation of the stored archives in accordance with our conditions of Privacy.

10) andalucia2.com has adopted the security measures exacted by the personal Data Protection Act in the handling of information provided by the User. Nonetheless, the total invulnerability of our security systems cannot be guaranteed, nor the inviolability of said data during transmission across the Internet, nor the absence of computer viruses. Nor can we be made responsible for failures that may arise in communications, including erasure, incomplete transmission or delays in the transmission of data.

11) In the online instant or immediate reservation system, if more than two persons or children, depending on their ages, will be sharing a room or apartment, the establishment may charge extra. Check the Special Conditions of the Provider on the reservation page of the establishment in question. In apartments, country houses, hostels etc., we must hereby advise you that the establishments are legally entitled to refuse entry to any individual whose inclusion in the arrangement was not declared at the time of making the reservation, by whatever means, and no refund may be requested in such cases.

12) We are sorry but pets are not normally admitted in establishments unless there is a specific statement to the contrary in the Special Conditions of the Provider.

13) Normally, and especially in the case of the instant reservation online system, extra beds, cots, use of the safe, food, breakfasts, half-board, laundry, mini-bar etc., unless included in the price (see Special Conditions of the Provider on individual reservation pages) must be contracted with the hotel by you.

14) Can I specify where I want the room (preferred floor, near the pool), double bed, twin beds, wheelchair access, special diets etc.? The Hotel will make every effort to accommodate you according to availability. We cannot guarantee the exact placement of the room, we simply do not know, but you can comment and make requests once you have received the confirmation e-mail from the Hotel, sent within a few days of your making a reservation through our system, or at any time thereafter.

15) Normally, check-in time is from 14.00 hours (2 pm) onwards and check-out is at 12.00 noon unless otherwise indicated in the Special Conditions of the individual establishment on the reservations page.

16) If the User will be obliged to arrive at the reserved Hotel at a different time or date from those agreed, let the Hotel know as early as possible (if last minute by telephone), to avoid problems and misunderstandings.

17) The most usual form of payment for instant hotel reservations (unless stated otherwise in the Special Conditions or on the individual reservations page) is 15% by credit/debit card at the time of making the instant online reservation through our website and 35% will be requested by the hotel when the reservation is confirmed, once we have passed on your details to them. The means of payment can be agreed between you and the hotel, usually you can fax your credit/debit card number to the hotel, pay by bank transfer or make payment directly into the hotel’s account. The remaining 50% is normally payable on arrival at the hotel (some hotels ask for 100% in advance and this will be stated in the Special Conditions of the Provider on the reservations page for the hotels in question).
In the pre-reservation system the payment will be (unless stated otherwise in the special Conditions of the Provider on the reservation page) Hotels will ask for your credit card details without deposit. Any other Hotel could ask you for 50% of the total amount on confirmation of the reservation and the other 50% on arrival at the hotel.

18) The User, in the purchase of a service, agrees to ratify and confirm that purchase and to pay the amounts owed by any of the means established for that purpose by andalucia2.com or its Providers.

19) Please note that it is not normally possible to make a reservation later (see the individual reservations page) than between twelf and twenty-four months in advance (depending on the hotel establishment).

20) Our reservation system will not prevent you from making impossible reservations, for example: the reservation of rooms later or before than is acceptable and possible to the establishment selected, erroneous bookings for the wrong period, duplicated bookings for the same date (where you have made reservations at two different establishments for the same period by mistake) etc.
If there should be any problem during the process of making a reservation (error, program failure, browser failure, etc.,) if you wish to know the status of your reservation after an error, an error message or failure has occurred, please with details of how the error occurred and what the error message said, including the name of the hotel on whose page it occurred and the details of the booking you were trying to make at the time, we will be able to help you.

21) Prices are in Euros, usually based on a room for two persons and for one night, (if sleeps any additional person, the Hotel could make a charge according to the Season), inclusive of taxes, unless otherwise stated on the reservations page of the hotel or in the Special Conditions of the Supplier on that page.

22) andalucia2.com guarantees a secure purchase/reservation online, through our system. Our goal is to provide you with a better way of making hotel reservations and contracting other travel services online without compromising the security of your credit/debit card. We take this matter very seriously. We employ advanced security technology for all credit/debit card transactions.

23) Due to the fact that the contract for the product is between the User and the Provider, any consultation, complaint or claim relating to the product must be directed at the Provider -as soon as possible- (although we would appreciate being informed, in the case of any complaint, of the outcome and degree of satisfaction obtained). Read the individual / Special Conditions.
You will find details of the Provider, name, address and contact information, in the confirmation e-mail that we send and in the individual Special Conditions of the establishment or the info pages.

24) andalucia2.com is free of any responsibility for non-fulfillment or defective fulfillment of contract on the part of the Providers of services, of their individual / Special Terms and General Conditions of sale of the services that they contract through our website. We so not accept responsibility for errors, losses, damage or accidents caused by factors beyond our control.

25) andalucia2.com acts as an intermediary and mere distribution centre for the Providers of these services and cannot be held responsible for over-booking, untruthfulness of information, whether textual or graphical, created by them, non-fulfillment or defective fulfillment by the Providers of products or services or any other dissatisfaction or complaint due to quality of service contracted through this website.

26) As we are travel agents and intermediaries, the offers of hotel accommodation and travel that you contract on our website cannot be considered as offers directly from us to the User, as they are offers from third party Providers and thus the Providers are responsible for any failure to provide the advertised products or services. (Should we ever act as principal or organizer and offer travel directly as Provider we would make this clear in these General Conditions and in the offer itself.) For this reason, our responsibility to the end User is limited to that which is established by the law pertaining to intermediary travel agents.

27) In all cases, the responsibility of andalucia2.com will be limited to the price paid by the User on contracting the service, expressly excluding all responsibility for direct or indirect damages, problems arising and/or loss of earnings.

28) andalucia2.com will not be responsible for disputes or controversy over the level of comfort of the hotel, prices, availability, service and quality of the same.

29) Cancellation policy varies from one hotel to another. You can direct any cancellations to the hotel via fax or e-mail, except some cases (see Specific Conditions of the Provider) and, if last minute, preferably by telephone. It is also necessary to send andalucia2.com a cancellation notice by . Cancellations should generally be made no later than three days before the reservation date, to avoid additional expenses, other than where otherwise stated in the individual / special Conditions or reservation page. Nonetheless, some hotels, in the high season, Easter week, Christmas period, Public Holidays and in the case of Conferences, impose other cancellation conditions. Read the individual / Special Conditions.

30) Changes to reservations are subject to availability at the time and must be requested sufficiently in advance. Contact the hotel direct via Fax or e-mail at the address that we include in our confirmation e-mail or, better still, if last minute, by telephone, except some cases (see Specific Conditions of the Provider). Bear in mind that some establishments may make a charge for any changes.

31) We remind you that you should have your documentation in order (including that of any children) passports, visas (where necessary) and other documents. We also recommend travel and medical insurance.

32) We place the maximum human and technical resources available to us at your disposal to identify and correct errors in data entry, our Customer service department has specialists in the hotel industry and the Internet, so that any doubt, question, error or mistake that may be encountered, or any help needed, during the reservation process, . We are here to help you, so that your experience of making hotel reservations online will be as pleasant as possible. Our On line Customer service department is open 24 hours of the day and seven days of the week, nonetheless, replies will be made during office hours, from 10:00 to 20:00 hours from Monday to Friday except on Public Holidays. The languages used for e-mail and the formalizing of contracts are English or Spanish.

33) andalucia2.com may cease to provide or change any of the services offered through this website, as well as some changes on this General Conditions or Special Conditions, without prior warning.

34) We link to many other websites not administrated by andalucia2.com. The said links are only made as listings in the Andalucia Internet Guide. andalucia2.com have no relationship with the said websites, excepting those that have some commercial relationship with us, but in no case are we responsible for the contents of those websites. If you should find a link that is broken, a website that contravenes the law, morality or good manners like, for example, sites containing violent sex and/or violence, etc., we would appreciate it enormously if you would inform us thereof so that we can suppress it. Links to other websites do not indicate that andalucia2.com promote, rate, guarantee or recommend those sites.

35) andalucia2.com offers no guarantees of any type as to the functioning of the website or the information, content, software, connections, products or services included on our web pages. andalucia2.com cannot be made responsible for any damage or problem arising from the use of this website including direct and indirect damage or problems. Nor does andalucia2.com offer a guarantee of any kind to Providers or Clients who have contracted to have a page on the website, promotion, publicity, forms, connections etc., necessary for making Hotel reservations or not, in any case responsibility will be limited to the price/commission paid by the Provider or the Client on contracting the service, expressly excluding all responsibility for direct or indirect damage, emergent damage and/or loss of earnings.
We do not accept responsability for information and/or opinions appearing in our Forums and chats.
We will make every effort to ensure that the information available on our website is as exact as possible. Nonetheless, we cannot guarantee that it will contain no errors, be complete and up to date. We will correct errors and omissions once they have come to our attention. We would ask you, please, if you see any error, inexact information etc., to indicate to us the name of the page in which you observed it.

36) On filling out the reservation/registration form and sending it, it is understood that you have read the Conditions on the page on which you made the reservation, the General Conditions and the individual / Special Conditions of the Provider / Supplier and confirm that you accept each and every clause of the same.

37) If, as a result of forces beyond our control (floods, fires, war, earthquakes or any disaster, natural or otherwise, total or partial strikes of transport or provision, governmental or legal restrictions, changes in the law) the contracted service cannot be partially or wholly provided, the User accepts that no claim of any kind can be made against andalucia2.com.

38) andalucia2.com and the User renounce their external legal codes and accept Spanish law as applicable to the functioning of this service submitting, for the resolution of any litigation or divergence derived from the interpretation or application of these General Conditions, to the Courts and Tribunals of Malaga.
